L+M, a major affordable housing developer, is suing Santander for refusing to accept the deed to a rent-stabilized building in Harlem. The property became financially unworkable after 2023 changes to New Yorkโs rent laws made it impossible to raise rents on reconfigured units.
L+M tried to walk away. Santander said no. Both sides are in court arguing over default clauses, nonrecourse language, and the meaning of โabandonment.โ
For real estate operators, especially in regulated markets:
